1. Introductory Provisions

By using the Prekucaj.com platform, you accept these terms in full. If you do not agree with any provision, please do not use our service. These terms apply to all visitors, buyers, and users who access this site or make a purchase.

Prekucaj.com is operated by Nova Digital Interactive LLC, a limited liability company registered in the State of Wyoming, USA. The mailing address of the limited liability company is: 30 N Gould St Ste N, Sheridan, Wyoming 82801, USA.

Transactions are processed in your country's currency (BAM, EUR, RSD, etc.) depending on the chosen payment method and location. We operate in compliance with applicable FTC guidelines regarding digital goods and consumer protection.

2. Access and Account Security

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country of residence. To use the Services, you may be asked to provide certain information, such as your email address and payment information. You represent and warrant that all information you provide is correct, current, and complete and that you have all rights necessary to provide it.

You are solely responsible for maintaining the security of any account credentials and for all activity associated with your account. You may not transfer, sell, assign, or license your account to any other person. If you believe your account has been compromised, please contact us immediately at info@prekucaj.com.

3. Subject of Service and Intellectual Property

Prekucaj.com is an independent digital retailer specializing in the distribution of official digital activation keys and software licenses for video games.

We do not sell physical copies of games. All trademarks, logos, and copyrights (including PlayStation, PS4, PS5) belong exclusively to Sony Interactive Entertainment and their respective publishers. Prekucaj.com is not an official partner, nor is it connected by ownership to Sony Interactive Entertainment.

4. Orders

When you place an order, you are making an offer to purchase. Nova Digital Interactive LLC reserves the right to accept or decline your order for any reason at its sole discretion. Your order is not accepted until we confirm acceptance. We must receive and process your payment before your order is accepted.

Please review your order carefully before submitting. In the event that we do not accept, modify, or cancel an order, we will attempt to notify you by contacting the email address provided at the time the order was placed.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

5. Purchase and Payment

An order is considered confirmed only after the system records the payment in full. Payments are processed through secure, encrypted gateway systems. Prices include all applicable taxes.

A 10% discount is applied automatically when the cart contains two or more different games.

Pricing errors: We reserve the right to correct any typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, and availability at any time without prior notice. We reserve the right to cancel any order placed for a product listed at an incorrect price, even after the order has been submitted and payment processed. If your payment has already been captured for an incorrectly priced order, a full refund will be issued promptly.

6. Delivery of Digital Content (Delivery Policy)

Delivery is carried out exclusively electronically — via email. The standard delivery time is within one hour of payment confirmation. In periods of high demand, the process may take up to two hours, and the maximum timeframe is 24 hours.

The customer is obliged to provide an accurate email address. Prekucaj.com is not responsible for delays caused by incorrectly entered data.

7. Refunds and Complaints (Refund Policy)

The buyer is entitled to a full refund or replacement within 14 days if the digital key has not yet been activated, or if there is a technical problem with the licence. Due to the specific nature of digital goods, refunds are not possible after a key has been successfully redeemed and the licence activated.

Exception: If the delivered digital activation key does not work due to an error on our end at the time of delivery, the customer must contact us within 24 hours. We resolve every justified complaint urgently — by replacing the key or providing a full refund. Canceling a purchase after the key has been redeemed and the licence activated is not a valid reason for a refund.

8. Limitation of Liability and Force Majeure

Prekucaj.com is not responsible for PlayStation Network outages, global changes to Sony's usage policies, or issues arising from user error when setting up the digital content on the console.

We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from circumstances beyond our reasonable control, including but not limited to: acts of God, government actions, internet or network failures, cyberattacks, platform outages (including PlayStation Network), or any other event outside our direct control.

9. Cookies

Our website uses cookies to enable basic functionalities such as the operation of the shopping cart and a secure checkout process. By using Prekucaj.com, you consent to the use of cookies necessary for the operation of the e-commerce platform.

10. Third-Party Tools

We may provide you with access to tools or features offered by third parties as part of the Services, which we neither monitor nor have any control over.

You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations, or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use of third-party tools is entirely at your own risk. You should ensure that you are familiar with and approve of the terms on which such tools are provided by the relevant third-party provider.

11. Eligibility

By placing an order on Prekucaj.com, you confirm that you are at least 18 years of age, or that you are using the platform with the explicit consent and involvement of a parent or legal guardian. We reserve the right to cancel orders where we have reasonable grounds to believe this condition has not been met.

12. Prohibited Uses

Purchased digital licenses are for personal use only. You may not use this site or its content for any of the following:

• Resell, redistribute, or transfer purchased licenses to third parties for commercial gain
• Use purchased content for any commercial purpose
• Attempt to circumvent any technical protection measures
• Submit fraudulent orders or initiate chargebacks for goods delivered as described
• Upload or transmit viruses, malware, or any other malicious code
• Submit false or misleading information during the order or complaint process
• Use automated scripts, bots, spiders, or scraping tools to collect pricing, inventory, or any other data from the platform
• Engage in any conduct that restricts or inhibits any other person from using the platform
• Harass, abuse, insult, harm, defame, or intimidate any of our staff or any other person
• Impersonate or attempt to impersonate any other person or entity

We reserve the right to terminate access to the platform for any user found to be in violation of these prohibited uses.

13. Automated Agents and AI Tools

This section applies if you use, allow, enable, or cause the deployment of any automated software, bot, spider, crawler, or AI agent ("Agent") to access, use, or interact with the Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity without direct human supervision.

We reserve the right to limit, block, or take technical measures against any Agent that does not comply with these requirements or that we determine, in our sole discretion, to be harmful to the Services or other users.

14. Refusal of Service and Fraud Prevention

Nova Digital Interactive LLC reserves the right to refuse service, cancel orders, or suspend access to any user at our sole discretion, including but not limited to cases involving suspected fraud, chargeback abuse, use of stolen payment methods, or any activity that violates these terms. Orders identified as high-risk may be subject to additional verification before processing.

We further reserve the right to limit or cancel quantities purchased per person, per household, or per order where we reasonably suspect unauthorized bulk purchasing, commercial reselling, or any violation of these Terms of Service.

15. Sanctions Compliance

In compliance with U.S. law and the regulations of the Office of Foreign Assets Control (OFAC), Nova Digital Interactive LLC does not process transactions for users residing in, or acting on behalf of, any country or individual subject to U.S. economic sanctions. By completing a purchase, you confirm that you are not located in, or acting on behalf of, any OFAC-sanctioned jurisdiction.

16. Feedback and User Content

If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, reviews, or other content ("Feedback"), you grant Nova Digital Interactive LLC a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback in any medium and for any purpose, including to improve, promote, and operate the Services.

You represent and warrant that: (i) you own or have all necessary rights to the Feedback you submit; (ii) your Feedback complies with these Terms; and (iii) your Feedback does not infringe any third-party rights, including copyright, trademark, privacy, or other proprietary rights. You may not submit Feedback under a false identity or on behalf of someone else without their knowledge.

We are under no obligation to maintain Feedback in confidence, pay compensation for Feedback, or respond to Feedback. We may, but are not obligated to, monitor, edit, or remove Feedback that we determine in our sole discretion to be unlawful, offensive, or in violation of these Terms.

17. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to its conflict of law provisions. Any dispute arising from or relating to these terms shall be subject to the exclusive jurisdiction of the courts of the State of Wyoming.

18. Indemnification

You agree to indemnify, defend, and hold harmless Nova Digital Interactive LLC, its officers, employees, affiliates, agents, contractors, and service providers from any claim, demand, loss, damage, or liability, including reasonable attorneys' fees, made by any third party due to or arising out of: (1) your breach of these Terms of Service; (2) your violation of any applicable law; or (3) your violation of any rights of a third party.

We will notify you promptly of any indemnifiable claim, provided that a failure to notify will not relieve you of your obligations unless you are materially prejudiced by the delay. We may control the defense and settlement of any such claim at your expense, but will not settle any claim that requires non-monetary obligations from you without your prior consent. You agree to cooperate in the defense of indemnified claims, including by providing relevant documents and information.

19. Disclaimer of Warranties

The Prekucaj.com platform and all content, products, and services available through it are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Nova Digital Interactive LLC does not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components.

20. Termination

We may terminate this agreement or your access to the Services, or any part thereof, in our sole discretion at any time and without notice. You will remain liable for all amounts due up to and including the date of termination.

The following sections will continue to apply following any termination: Subject of Service and Intellectual Property (Section 3), Feedback and User Content (Section 16), Indemnification (Section 18), Disclaimer of Warranties (Section 19), Limitation of Liability (Section 8), Severability (Section 21), Waiver (Section 22), Entire Agreement (Section 23), Governing Law (Section 17), Privacy Policy (Section 25), and any other provisions that by their nature should survive termination.

21. Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity or enforceability of any other remaining provisions.

22. Waiver

Failure by Nova Digital Interactive LLC to enforce any right or provision of these Terms of Service shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will only be effective if made in writing and signed by an authorized representative of Nova Digital Interactive LLC.

23. Entire Agreement

These Terms of Service, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Nova Digital Interactive LLC with respect to your use of the platform and supersede all prior or contemporaneous understandings, communications, or agreements, whether written or oral, relating to the subject matter herein. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

24. Assignment

You may not delegate, transfer, or assign this agreement or any of your rights or obligations under these Terms without our prior written consent, and any such attempt will be null and void.
